COMPLETE LIABILITY RELEASE & ASSUMPTION OF INHERENT RISKS
Pursuant to Hawaii Revised Statutes § 663-1.54:
I HEREBY ACKNOWLEDGE, UNDERSTAND, AND AGREE that sportfishing, boating, and related ocean activities involve physical exertion in a marine environment that expose me to risk of injury, illness, or death, and other potential hazards, any or all of which may not be visible, known, or anticipated. I agree these are all INHERENT RISKS of engaging in offshore sportfishing.
Inherent risks include, but are not limited to:
- Marine & Weather Conditions: High ocean swells, rogue waves, turbulent water, sea spray, sudden shifts in weather, motion sickness, intense sun and heat exposure, and slippery deck surfaces.
- Vessel Operations: Unpredictable boat movement, sudden pitching, rolling, engine exhaust, boarding or disembarking at harbor docks and swim platforms.
- Tackle & Mechanical Equipment: Sharp fishing hooks, gaffs, wire leaders, weighted sinkers, snapped monofilament/braid lines, fighting chairs, and high-tension reels.
- Handling Large Marine Life: Encounters with hooked or landed pelagic fish (such as Marlin, Ahi/Tuna, Ono/Wahoo, and Mahi-Mahi) possessing sharp bills, teeth, fins, and powerful thrashing capabilities.
DUTY TO EXERCISE CARE & SAFETY INSTRUCTIONS:
I understand that I have an active duty to exercise reasonable care for my own safety and the safety of others. I agree to abide by all safety briefings, rules, and instructions given by Captain Shawn and the crew of Playtime Sportfishing at all times.
MEDICAL & RESCUE CONDITIONS:
The participating Released Parties and/or vessel have made no representation to me implied or otherwise that they or their crew can or will perform safe rescues or render professional first aid. In the event I show signs of distress or call for aid, I request assistance and will not hold the Released Parties or their crew responsible for actions taken in attempting rescue or first aid. I understand the vessel operates offshore with limited medical facilities; in the event of serious illness or injury, medical care must be summoned by radio and may be delayed until transportation to an onshore medical facility is achieved. I agree in advance to these operational realities.
PHOTO & VIDEO RELEASE:
I grant MAKANA LANI Charter LLC dba PLAYTIME LLC the right to photograph, videotape, and/or record me and/or my minor child(ren) and to use our likeness, voice, and appearance in connection with publicity, social media, website, and promotional materials without compensation.
